Overview

This website is operated by Waddington Educational Resources Pty Ltd. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”).

 

Payment

All Australian schools and Australian government departments identified are automatically given a 30 day account, whereby payment can be made before, during or up to 30 days after tax invoice date. Buyers without an approved 30 day account are given up to 3 days for payment to come through, before dispatch if stock still available, otherwise the order will be cancelled and deleted. Orders submitted via our website shopping cart system earn reward points. Online orders and their reward points compile in your respective login account order and reward point history. We currently do not send physical goods to overseas destinations outside of Australia.

 

Deliveries

We try to process orders same day if received prior to 2pm. Rapid despatch option at checkout can expedite despatch within a business day (24 hour period) if selected.

All software download deliveries are processed manually. We try and process download orders same business day but please allow up to 24 hours.

All physical parcel deliveries go via Australia Post, charged according to flat-rates for physical goods up to 20kg based on your total order $ value to anywhere in Australia. If near/over 20kg (actual or cubic weight), more than one parcel required or for very remote destinations, multiple flat-rate charges may apply. Please allow between 2 to 7 business days to reach destinations across Australia. Contact us if you need Express Post but please be aware that it comes at a higher cost in line with Australia Post's charges, handling added and delivery times ultimately depend on your location which may take more than one business day. We do not send physical goods to destinations outside of Australia.

 

Our Promise to You and Guarantee

If you are unhappy with any purchase, please let us know immediately and we will do our best to resolve any issue. We want all our customers to be pleased with every purchase and be happy with our service because we value your business. If any problem is our fault, we will work with you to find a solution. One solution may be our free post return label service where goods can be returned free of postage costs, even picked up by your regular Australia Post deliverer or lodged at any Post Office.

You can return items under our general guarantee if in original condition and within a 7 day decision period after delivery for a credit covering the product cost. Made-to-order items are not refundable.

If a return is not due to our/a fault, a 20% restocking fee may be applied. A restocking fee may be applied due to late order cancellations, if returns involve large orders, repackaging and/or re-stocking of manufactured goods such as kits. The re-stocking fee may be applied to any eBay returned orders or where a customer chooses to cancel an order that contained customised manufactured items already processed, packaged but not dispatched. Special orders featuring large quantities, special prices and/or made to order arrangements, are non-refundable and the buyer is committed to the purchase once it is processed, manufactured and/or ordered in.

Delivery/postage, handling and other surcharges are not refundable.

Tiered/discount prices and/or free gift offers are provided only when a sale meets stated conditions such as minimum order quantity/value. If available stock unit quantity and/or availability time shows for a product, it is a guide only and may change without notice or experience update delay during periods of high demand or slower than expected re-stocking arrival. Newsletter special offers are generally restricted to newsletter recipients.

We provide free 30 day hosting so customers can download their purchased ebook and/or software files. Once a 30 day hosted download link expires, the download file is removed from our server and the file is no longer available, which is why we state within every download file, "Please ensure you keep a back-up copy of your software". Replacement of lost, damaged and/or misplaced software is only possible via customer purchase of the current version/edition available.

Software and ebooks cannot be refunded once a download link or USB is supplied, or codes received/opened, because all registered ebooks and software are individually stamped/encoded with the end user's details.

We take no responsibility for lost/missing parcels, especially if customers instruct us to leave parcels somewhere without person to person delivery confirmation, which involves selecting the signature on delivery service at checkout. Australia Post does not provide any service guarantees.

An office processing fee, in the amount of $33.00 including GST, may be charged for each and every month that goes by as we seek payment beyond the 30 day account grace period. Customers who do not meet our 30 day account provision or fail to pay their account on time, will be required to pay prior to order processing and despatch.

Accounts in credit must use credit for future purchases if a refund request is not made within 7 days. Account credit unclaimed after 12 months may be forfeited but will be maintained for an additional 12 months if requested. Account credits or debits less than a few dollars may be reconciled within a shorter time to avoid unnecessary statements being issued.

Software Terms of Use & Copyright

Most of our publications and software (e.g. ebooks) are registered to an individual or a site (site/school name must be supplied), as the buyer, with name and locality stamped/digitally encoded within the file, for use only by the named individual for his/her personal use with his/her own students or if site registration, by a named site (e.g. school) on their one physical site under our Terms of Use. This is not only a condition of our copyright but it is also a condition you accept once you buy and/or use our resources. Please ensure you keep a back-up copy of your software. Replacement of lost, damaged and/or misplaced software is only possible via customer purchase of the current version/edition available.

We rely heavily on users (e.g. schools) attributing any copying of our works to the author when they are surveyed by copyright collecting agencies, as the sales of our resources alone do not cover the cost of their development. For example, the Waddington Diagnostic Standard and Advanced Reading and Spelling Tests 1 & 2 Third Edition took over 3 years to create. The sales of that ebook, either registered to a school or an individual, does not cover its development cost alone. That is why we rely heavily on users recording and attributing any copying if sampled by copyright agencies. By doing this, you help the vast majority of schools and individuals to buy our resources at a reasonably low cost and then being able to copy what they need under Statutory Licence, when they need it, without time limiting or annual subscription restrictions - as long as that copying is attributed when sampled. Like we say, we rely on YOU!

We reserve the right to refuse service to anyone for any reason at any time.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We may, but have no obligation to, monitor, edit or remove website content. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party. Your submission of personal information through the store is governed by our Privacy Policy.

We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information at any time without prior notice (including after you have submitted an order).

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall Waddington Educational Resources Pty Ltd, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
